Companies appear to face a greater threat of litigation over discrimination against members of minority groups than over discrimination against white people. The Supreme Court decision on college admissions could lead companies to alter recruitment and promotion practices to pre-empt legal challenges. As a legal matter, the Supreme Court’s rejection of race-conscious admissions in higher education does not in itself impede employers from pursuing diversity in the workplace.
