Appeals Court Temporarily Reinstates Trump's Tariffs

Summary from the AllSides News Team

After a federal court blocked President Donald Trump's tariffs on Wednesday, an appeals court temporarily reinstated them Thursday while it considers an appeal from the Trump administration.

The Details: The United States Court of Appeals for the Federal Circuit issued an administrative stay of the lower court's decision to block Trump's tariffs as it considers court fillings. The Trump administration argued that halting the lower court order is “critical for the country’s national security.” The United States Court of International Trade had previously ruled that tariffs issued under the International Emergency Economic Powers Act (IEEPA), which is typically used to address issues of national emergencies, were an overreach. The court noted that tariffs needed the approval of Congress in most circumstances.

For Context: The Wall Street Journal (Center bias) reported that the White House is considering imposing 15% tariffs for 150 days on US trade partners by invoking a little-known provision of the 1974 Trade Act. This stopgap measure would buy the Trump administration time to draft individual tariff plans for its trading partners using a separate provision of the same law targeting what it considers unfair trade practices.

How The Media Covered It: Al Jazeera (Lean Left) said, "Experts believe that, ultimately, the tariffs will not last." ABC News (Lean Left) and The Blaze (Right) noted that of the three-judge panel that struck down the tariffs on Wednesday, one was Trump-appointed.
