How Will New Ruling on Social Media Censorship Impact the 2024 Election?

Following a judge's order that Biden administration officials can't push social media companies to censor “content containing protected free speech,” voices across the spectrum are speculating on the implications for 2024 and beyond. 

Wild West: Coverage from The Hill (Center bias) quoted supporters and opponents of the judge’s order. It quotes Sen. Eric Schmitt (R-MO) calling the ruling a “huge win for the First Amendment and a blow to censorship.” It also quotes Darrell West, a senior fellow at the Brookings Institution’s Center for Technology Innovation, warning of a “wild west of disinformation” heading toward the 2024 election season.

Dangerous Information: A New York Times (Lean Left bias) analysis determined the “government’s actions at the heart of the case were intended largely as public health measures” but were viewed by the judge “through the filter of partisan culture wars.” The outcome of the continuing legal battle, the article stated, could “shape the future of First Amendment law” and “alter how far the government can go in trying to prevent the spread of potentially dangerous information.”

Tainted Elections: An opinion piece in The New York Post Opinion (Right bias) asked, “When did the Biden administration become infallible with a divine right to nullify the free speech of conservatives?” The article outlined efforts by the Biden Administration and federal agencies to remove posts and accounts from social media sites, determining, “Federal censorship tainted the 2020 and 2022 elections, spurring the suppression of millions of social-media posts (almost all from conservatives).”
