Judge Imposes Limited Gag Order on Trump in 2020 Election Case

The judge overseeing the Justice Department's federal election interference case against 2024 GOP frontrunner and former President Donald Trump imposed a limited gag order on Trump, restricting his ability to publicly comment on certain individuals involved in the trial.  

Details: Judge Tanya Chutkan’s “narrowly tailored” gag order restricts Trump from posting statements online targeting Special Counsel Jack Smith or Smith’s staff, as well as court staff and witnesses. The gag order does not restrict Trump from criticizing Washington D.C. or from claiming that the trial is politically motivated. The judge also reiterated that the trial’s March start date will not change.

Key Quotes: Issuing the gag order, the judge stated, “First Amendment protections yield to the administration of justice and to the protection of witnesses. His presidential candidacy does not give him carte blanche to vilify … public servants who are simply doing their job.” Shortly after the judge’s decision, Trump spoke at a campaign event in Adel, Iowa, where he stated, “I'll be the only politician in history that runs with a gag order where I'm not allowed to criticize people. Can you imagine this? Do you believe this? I'm not allowed to criticize people, so we'll see. We'll appeal it and we'll see but it's so unconstitutional.”
