Republicans Ask Supreme Court to Weigh in on Pennsylvania, Virginia Voting Issues

Summary from the AllSides News Team

Republicans are asking the Supreme Court to weigh in on voting issues in Pennsylvania and Virginia.

Pennsylvania: The Republican National Committee (RNC) is asking the Supreme Court for a stay on a decision by the Pennsylvania Supreme Court, which ruled that provisional ballots must be counted if the ballot was mailed in on time. In Butler County, some provisional ballots were not counted because they did not have a proper envelope, which the RNC says complies with state law. If the Supreme Court upholds the Pennsylvania court's decision, the RNC asks that provisional ballots be sequestered for future judicial review, arguing that the case potentially impacts tens of thousands of votes.

Virginia: The Supreme Court has allowed Virginia to remove around 1,600 registered voters from their voter rolls over concerns that they're noncitizens. On Friday, U.S. District Judge Patricia Giles ruled that the effort violated federal law because it took place during a 90-day "quiet period," which is mandated to avoid mistakenly removing legitimate voters just before the election. This ruling was upheld by the 4th U.S. Circuit Court of Appeals on Sunday, which found that states can remove noncitizens from the rolls, but that it must be an individual process and not based on bulk DMV data transfers. Meanwhile, registered voters who have affirmed their citizenship have retained their eligibility to vote.

How the Media Covered it: CNN (Lean Left bias) suggested it's unclear if any of the pending election cases before the Supreme Court will have a dramatic effect on the 2024 presidential election. Fox News (Right) highlighted how 26 Republican attorneys general came out in support of Virginia's appeal.

Republicans asked the US Supreme Court on Monday to step into a fight over provisional ballots in the presidential battleground state of Pennsylvania, bringing a second potentially significant voting case to the high court within days of the election.

The Republican National Committee urged the justices to block a state court ruling that allows people to vote provisionally when election officials identify problems with their mail ballots – specifically, when they fail to put them into a “secrecy” envelope before sending them off in the mail.

Virginia appealed to the U.S. Supreme Court on Monday to allow the state to remove around 1,600 registered voters it alleges are noncitizens. The federal appeals court upheld a judge's order that restored these voters' registrations, ruling that the state's removal program was unlawfully implemented. In August, an executive order was issued by Gov. Glenn Youngkin, a Republican, mandating daily data checks to identify noncitizens on voter rolls. Youngkin insists that the program is a necessary measure to prevent noncitizens from voting in the upcoming November election. What is an...
