Lawsuit Alleges ICE Violated Man's First Amendment Rights

US Immigration and Customs Enforcement (ICE) was sued on Monday over a First Amendment violation after agents showed up to a New York man's house over his criticism of the agency.

The Lawsuit: David Streever sent an email to former ICE Acting Director Todd Lyons in January expressing his frustration over two fatal shootings in Minneapolis by ICE agents. According to NewsNation (Center bias), the lawsuit alleges the Department of Homeland Security (DHS) is "actively threatening" First Amendment rights of Americans by tracking down and retaliating against US residents like Streever because he criticized a high-ranking US official. DHS and ICE shared statements calling the allegations of attempting to "squash" free speech "categorically false" and said they investigate all "credible threats" made against employees and officers. Streever is being represented by the FIRE Organization (Center)

The Incident: Court records described ICE special agents David Brodie and Abbi Henry visiting Streever's Rochester home on June 23 and handing his wife a document that read "warning notice," claiming that his email was considered a threat. Streever claimed that a DHS agent tracked him and his 7-year-old daughter to a New York City hotel as they traveled home from Finland. 

Omission of the Email: Outlets including Wired (Lean Left) and Straight Arrow News (Center) didn't include what Streever said in his email in their coverage. Instead, they focused on quotes from FIRE leaders defending his right to free speech. Fox News (Right), The Hill (Center) and Reason (Lean Right) quoted a part of Streever's email where he called Lyons "a monstrous human being" who "will never know peace" and will "go down in history as America's Reinhard Heydrich, the butcher." Many other left-leaning and center outlets only reported that Streever called Lyons "a monstrous human being" and that he'd have the ICE operations "on his conscience." Fox quoted the email for in-depth. 

Government Overreach: Many center and left-leaning outlets also contextualized the lawsuit within another recent incident of ICE agents tracking down Paigelynne Gonyea, an online influencer, after she also criticized ICE operations. Reason said that "labeling clearly nonthreatening speech as threatening has become a common tactic used by the Trump administration." Washington Post (Lean Left) cited civil liberties experts who warned these warnings from ICE agents "mark a new development in a broader campaign by DHS to track and intimidate its critics."
