Federal Judge Rules Trump's LA Troop Deployment Illegal

President Donald Trump’s deployment of National Guard troops in Los Angeles was ruled unlawful by a Federal Judge on Tuesday.

The Details: Judge Charles Breyer ruled that Trump and Secretary of Defense Pete Hegseth violated the Posse Comitatus Act by utilizing the military for domestic law enforcement. The order is paused until Friday, September 12, allowing the Trump administration time to file an appeal. Once in effect, any remaining federal troops will be barred from engaging in civil enforcement, including conducting arrests and searches, or performing traffic patrol or riot enforcement.

For Context: The Posse Comitatus Act, enacted in 1878, prohibits the use of military forces to enforce laws except under circumstances expressly authorized by the Constitution or an Act of Congress. Trump deployed at least 700 Marines and an additional 2,000 National Guard troops into Los Angeles following protests against Immigration and Customs Enforcement (ICE) in June. The Trump administration has threatened to send National Guard troops to Chicago and recently sent troops to Washington, DC. Breyer’s order applies only to California, but he warned that Trump’s threats of troop deployments elsewhere risk “creating a national police force with the President as its chief.”

The Hill (Center) noted the “major confrontation between Trump and Newsom,” saying Newsom “has leaned into his role as a visible Trump foe to energize Democrats eager to see members of their party fight back at the president.”
