New Guidelines on Campus Sexual Assault

• Earlier this month, Education Secretary Betsy DeVos issued new regulations on the enforcement of Title IX protections against sexual harassment. The changes are modified from a Draft Rule released for public comment in November 2018.
• Schools will now be required to inform accused students that they are innocent until proven guilty. Accusations must now be adjudicated in live hearings where both the accused and the accuser can be cross-examined. And schools will now have the flexibility to require "clear and convincing evidence" instead of the Obama-era "preponderance of evidence" standard.
• The new regulations define sexual harassment "to include sexual assault, dating violence, domestic violence, and stalking, as unlawful discrimination on the basis of sex," and as “severe, pervasive and objectively offensive.”
• Interested groups have praised or criticized a wide variety of individual changes in the new regulations. Last week, the ACLU filed a lawsuit against Secretary DeVos on behalf of four advocacy groups.
