District Judge Orders 'Immediate' Release of Kilmar Abrego Garcia

Xinis said in an opinion that his release is due to being "held in ICE detention to effectuate third-country removal absent a lawful removal order."

For Context: Abrego Garcia was wrongly deported to CECOT, a notorious prison in El Salvador, following what US Immigration and Customs Enforcement (ICE) called an administrative error. He was then ordered to be returned to Tennessee, where he denied a plea deal for federal human smuggling charges, and was informed directly after his release from jail that he may be deported to Uganda. The unauthorized migrant from El Salvador, who arrived in the US illegally in 2011, reported being tortured during his time spent at CECOT. The situation surrounding Abrego Garcia garnered national media attention, with some on the left calling him a "Maryland man" or "wrongly deported" and some on the right opting to describe him as an "illegal" migrant or suspected gang member. The government attempted to deport him to an alternate country but was unable to secure the court's approval.

How The Media Covered It: Outlets on the right, like The Daily Wire (Right bias), generally highlighted the fact that the judge ordering the release was appointed by former President Barack Obama, including commentary from Department of Homeland Security Secretary Tricia McLaughlin, who called the decision "naked judicial activism."  Just the News (Lean Right) also included commentary from Article3Project founder Mike Davis, calling Xinis "a lawless and dangerous radical," saying "she just literally ordered the release of 'Saint' Kilmar Abrego Garcia, an MS13 terrorist and the Democrat patron saint of wife-beating and human trafficking." Others on the left, such as HuffPost (Left), tended to highlight the error in sending Abrego Garcia to CECOT, while also mentioning the evidence claiming he is affiliated with MS-13 or has engaged in human trafficking is "very thin and often unsubstantiated." Left outlets like ABC News (Lean Left) also generally framed Abrego Garcia as a man "who had been living in Maryland with his wife and children."
