Judge Blocks Federal Funding Cuts To Planned Parenthood

Massachusetts District Judge Indira Talwani blocked federal funding cuts to Planned Parenthood on Monday, after ruling that the cuts are “likely unconstitutional.” 

The Details: The year-long cuts – a provision of President Donald Trump’s “One Big Beautiful Bill Act” – would have ended Medicaid reimbursements for all abortion providers that received over $800,000 in reimbursements in 2023. Talwani argued they would violate the US Constitution’s First Amendment “right of association” for Planned Parenthood services that do not pertain to abortion, and court documents also cited equal protection implications in the Fifth Amendment. The documents stated, “The legislative history and context confirm that the law’s purpose is to single out Planned Parenthood Federation and its Members for punishment.” The Department of Justice (DOJ) argued the bill merely stops taxpayer funding of Big Abortion and accused Talwani of unjustly pushing her personal bias into legislation. 

For Context: Talwani blocked the provision for some Planned Parenthoods last week, but she expanded the block nationwide on Monday. Taxpayer funding for Planned Parenthood, which included Medicaid reimbursements, reportedly reached $699.3 million in 2022-2023. The attempted provision parallels the Hyde Amendment, which prohibits the use of federal taxpayer dollars for most elective abortions.

How The Media Covered It: Outlets across the political spectrum noted that Talwani was appointed by former President Barack Obama, but several outlets on the right – including Daily Caller (Right bias) – highlighted the fact in their headlines. CNN (Lean Left) did not give voice to support for the provision, while both The Caller and Reuters (Center) did. Reuters was the only outlet of the three to note that Talwani labelled the provision as “likely” unconstitutional.
