FDA Expands Abortion Pill Access

The Food and Drug Administration (FDA) finalized a rule change on Tuesday that allows anyone with a prescription to purchase certain abortion pills from any certified retail pharmacy or mail order service.

For Context: Certified pharmacies will now provide mifepristone, which is the first of two medications needed to induce a medicated abortion, directly to the patient. Previously, the pills were only available through a few mail order services or in person from a doctor or clinic. Mifepristone blocks progesterone, a necessary hormone for pregnancy.  Misoprostol, which is taken 1–2 days after mifepristone to induce contractions and expel pregnancy tissue, is already available over the counter. Medicated abortions account for over half of the abortions in the U.S. today. Over 3.7 million women have used mifepristone since it was approved by the FDA in 2000. 

What's Next: CVS and Walgreens, the largest pharmaceutical chains in the U.S., said they plan to become certified and offer the pill to patients. They will have to comply with state restrictions, such as in Tennessee, where mailing abortion pills is a criminal offense.

The Food and Drug Administration on Tuesday finalized a rule change that broadens availability of abortion pills to many more pharmacies, including large chains and mail-order companies.

The Biden administration partially implemented the change last year, announcing it would no longer enforce a long-standing requirement that women pick up the medicine in person. Tuesday’s action formally updates the drug’s labeling to allow many more retail pharmacies to dispense the pills, so long as they complete a certification process.

A Food and Drug Administration (FDA) rule change will allow U.S. retail pharmacies to offer abortion pills directly to patients with a prescription, suspending a long-standing requirement that the pills be dispensed in person by doctors or clinics. 

GenBioPro and Danco Laboratories, which make the generic abortion pill mifepristone, have said the FDA informed them about the change to its risk evaluation and mitigation strategy (REMS) for the drug, and the FDA is expected to update its website late Tuesday.

Walgreens and CVS, the two largest pharmacy chains in the U.S., plan to provide abortion pills in store following a recent FDA regulatory change that permitted retail pharmacies to dispense the medicine.

Under the agency’s rule revision, pharmacies can apply to become certified to offer mifepristone, which can terminate pregnancies in the first-trimester in conjunction with a second drug, misoprostol.
