Texas Supreme Court Permits Investigations of Families with Trans Kids To Resume
AllSides Summary
A Texas Supreme Court ruled Friday that state government officials can continue to investigate parents and doctors for potential child abuse if they provide gender-affirming care for trans youth.
Texas Gov. Greg Abbott ordered state officials in February to start investigating if certain treatments for transgender youth like hormones and puberty-suppressing drugs constitute child abuse. The decision overturns a lower court's injunction from Mar. 11 that found Texas Gov. Greg Abbott's policy was "beyond the scope of his authority and unconstitutional." Some Texas families with transgender children are considering moving outside of the state as a result of "the threat of these investigations."
Left-rated outlets were more likely to describe gender-affirming care as "medically necessary" and "evidence-based care." They also emphasized data that highlighted how thousands of transgender youth across the country are facing "restricted access" that has impacted their mental health. Conversely, right-rated outlets were more likely to highlight the court ruling in a positive light and include quotes from Abbott where he claimed gender reassignment surgery creates a "genuine threat of substantial harm from physical injury."

Greg Abbott, and the DFPS began investigations of families for potential child abuse over treatments their transgender children were receiving in February. An appeals court had previously blocked these inquiries throughout the state, but the Texas Supreme Court ruled the lower court had...

Texas allowed to resume investigations of families with trans kids

A Texas Supreme Court ruled Friday that the state could resume investigating parents for child abuse if they seek gender-affirming care for transgender kids.
Why it matters: The decision reverses an injunction by a Texas appeals court in March that temporarily blocked such investigations.
The big picture: The court's ruling leaves the injunction in place for the family that originally filed the case's initial lawsuit as the case goes to trial.
- The ruling also stated that the appeals court had "abused its discretion" by issuing a statewide order.
- The probes began after Texas Gov. Greg Abbott ...

Texas can continue investigating families seeking gender-affirming care for their transgender children, state Supreme Court says

After a pause on investigations of families seeking gender-affirming care for their transgender children, the Texas Supreme Court said the state’s child protective services investigations can continue while an appeals process plays out on the merits of the case.
The opinion released Friday still restricts the state from investigating the so-called “Doe” family, which brought forward a lawsuit against the state in March after the family was investigated by the Department of Family and Protective Services for seeking care for their trans teen.
And significantly, the opinion also denied that Gov. Greg Abbott...
